Pursuant to Ohio Revised Code 2305.24 and 2305.253, the information contained in incident reports or risk management reports is confidential and shall be used by the appropriate hospital performance improvement and or quality assurance committees and committee members only in the exercise of the proper functions of the committee. Such reports and their contents are not subject to discovery in, and are not admissible in evidence in the trial of, a tort action.
